General
Terms and Conditions
1.
The registration is subject to the services listed in this program.
The registration is only valid after receipt of our written confirmation
of the booking and receipt of the initial payment. The price has to
be paid in Euro or US Dollar Traveller cheques upon arrival in Bali.
The costs of the trip are calculated on basis per person in double-rooms.
For singles it is possible to book ½ room (in this case we would arrange
a 2nd person for the room) or a single room. On the Bali & Java Adventure
tour the camping can only take place in double-tents due to the small
capacity of the campground.
2.
The included services of the organizer are explained in detail in the
descriptions of each tour. Changes due to storms or other environmental
conditions are in the responsibility of the organizer.
3.
The order of the daily tours are subject to changes which might be necessary
due to unforeseeable circumstances (i.e. weather).
4.
Withdrawal of the organizer Requirement for the performance of a tour
is a booking of at least 4 persons per tour. In case this minimum of
participants has not been achieved, the organizer may cancel the tour
until the 21st day before tour-start latest.
5.
Each participant has to provide his bike himself. Mountain bikes are
necessary. Your bike should have been checked thoroughly before the
trip. For emergencies some tools are kept in the accompanying bus. From
April 2005 you can rent a bike.
6.
We do not accept liability for stolen luggage during the tour. We recommend
to cover a corresponding insurance.
7.
Liability
a) The organizer is responsible for the correctness of all the tour
descriptions and the services included each, as well as a conscientious
planning and enrolment of the tours.
b) The participant takes part on his own risk. He is especially responsible
for his correct behaviour in driving according to the valid law and
regulations in the destination country. There is no duty to wear a helmet
in Bali, but we recommend it strongly to take a helmet with you.
c) We are not liable for the damages resulting of the negligence of
one's duties by the participant, other participants or third persons.
d) Each traveller is responsible himself to be in the appropriate health
condition for his tour.
e)
The liability of the organizer for damages, which are not injuries to
persons, is limited to the triple height of the price of the tour, as
far as the organizer has not acted deliberately nor negligent, or if
the organizer is responsible for the damages of one of the service providers
chosen by him.
f) For all compensations of the client against the organizer, which
are not resulting from intention or negligence, the organizer is liable
for up to Euro 20.000 per person/trip in case of injuries to persons.
This limited liability is not valid when the organizer is to be held
responsible for the selection of the relevant service.
8.
Special outdoor risks It is obvious that for all Bike- and Trekking
tours outside the risk for illness, accidents or injuries is relatively
high. That cannot be excluded completely even with the best possible
care during the tour. This risk has to be taken by each client. You
also have to consider that in the nature of the tours, it is nearly
impossible to receive adequate medicinal treatment due to the technical
and logistical problems in the regions the tours are taking place. So
even the slightest injuries or incidents may lead in the worst case
to severe problems. We ask the participants to take care of themselves
in acting responsible and careful, an appropriate training for the tour
is essential. The participation is on own risk and responsibility.
9.
Guarantee and Consumption In case there is reason for reclamation despite
the thorough planning of the tours, you have all the legal rights, after
having given an appropriate time for improvement, provided you didn't
neglect to inform the organizer of the shortcoming directly. There is
no deadline if the solution of the shortcoming is impossible, is restricted
or not possible due to the special interest of the travelling group.
The demands for consumptions have to be claimed according to the law
during one month after termination of the trip at Cocostravel Werner
Duderstadt. After the period of one month you may only make demands
for consumption when you have been prevented from it innocently. The
period for consumption demands ends after 6 months after termination
of the trip.
10.
Each participant needs a valid passport and is responsible for the correctness
of the document.
11.
The invalidity of some of these regulations does not affect the legal
effects of the remaining regulations. Verbal agreements have to be confirmed
in writing by the organizer.
12.
Starting point for all the tours is Airport Denpasar (Bali).
